Reglan and Tardive Dyskinesia

Our lawyers have gathered over 200,000 pages of drug company documents which have been found by several courts to support the claims of negligent, willful and wanton misconduct by manufacturers of Reglan. Many of our Reglan (or generic metoclopramide) cases have been settled for confidential amounts with drug companies and prescribing physicians. All of the others are still pending resolution. In additiion, some of our clients have reached settlement agreements with the manufacturers of Reglan which permits us to make company documents and depositions which cost those clients hundreds of thousands of dollars available to new clients at a small fraction of the cost that would be incurred by law firms who do not already have those documents and depositions. Metoclopramide is a drug that is used to treat gastroesophogeal reflux disease (reflux of stomach acid contents into the lower esophogus and commonly called "heartburn") and delayed gastric emptying that is associated with diabetes ("diabetic gastroparesis").

Tardive dyskinesia is a drug induced neurological disease which usually involves involuntary movements of the mouth, face and tongue. It can also include involuntary movements in the trunk and extremities. There is no known FDA approved treatment for tardive dyskinesia and it may be irreversible.

Metoclopramide has been approved by the FDA only for short-term use in the symptomatic treatment of gastroesophageal reflux disease for up to 12 weeks and for treatment of diabetic gastroparesis for up to 8 weeks.However, a published study from a leading medical school has found that nearly one-third of all patients who receive Reglan or generic metoclopramide receive it for 12 months or longer rather than 12 weeks or less. Often this is the result of physician negligence and therefore most of our clients have sued the prescribing physician as well as the drug company that manufactured the metoclopraide. Howver, the drug companies are aware of the fact that physicians frequently prescribe metoclopramide for uses that are not approved by the FDA and consequently, we have sucessfully maintained that the drug companies are primarily responsible for most of the Reglan or metoclopramide injuries.

The most compelling reason to hold the drug companiies responsible is the fact that two independent well done studies by two separate leading medical schools have found that the risk of developing tardive dyskinesia and other neurological injuries from long-term use of Reglan and metoclopramide is 100 times greater than claimed by the drug companies.
